Terms of Use

1. Who we are

The Service is provided by Vianim, established in the European Union. Contact: support@vianim.com. For formal legal notices, email support@vianim.com and we will provide our registered entity details on request.

2. The Service

Vianim lets you upload or import a GPX track (parsed in your browser into GeoJSON), preview a cinematic 3D map animation in the studio, and export a rendered video for download. Features available to you depend on your plan (Free, Plus, or Pro).

Rendered export files are ephemeral: they are delivered via time-limited signed download URLs and are automatically purged from our private cloud storage after about 48 hours. You are responsible for downloading and backing up exports you want to keep.

3. Accounts

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. Notify us promptly at support@vianim.com if you suspect unauthorized access.

You must be at least 16 years old, or the minimum age of digital consent in your EU member state if higher, to use the Service.

We may suspend or terminate accounts that violate these Terms or that present a security or abuse risk.

4. Your content and license

You retain ownership of GPX tracks, GeoJSON routes, waypoint text, and photos you upload (“Your Content”).

You grant Vianim a limited, worldwide, non-exclusive license to host, process, transmit, and display Your Content solely as needed to provide the Service (including storing projects, generating previews, rendering exports, and delivering downloads). We do not claim ownership of Your Content and do not use it for advertising.

You represent that you have the rights needed to upload Your Content and that it does not infringe others’ rights or applicable law.

5. Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes.
• Upload content you are not entitled to use, or that is illegal, defamatory, or invasive of privacy.
• Attempt to bypass plan limits, abuse the render queue, reverse-engineer the Service in a way that violates applicable law, or interfere with other users or our infrastructure.
• Scrape, overload, or automate access in ways that degrade the Service or violate third-party terms (including Mapbox tile usage).

6. Plans, billing, and cancellation

Current plans (prices may change with notice; the pricing page and checkout are authoritative at purchase time):

• Free: up to 3 video exports per UTC calendar month, 720p at 30fps, shorter duration, with watermark. Advanced features such as multi-transport legs, text waypoints, and photo waypoints are not included.
• Plus ($9/month or $72/year): unlimited exports up to 1080p at 60fps, longer duration, no watermark. Cinematic map looks beyond the Free theme. Advanced route storytelling features remain Pro-only.
• Pro ($19/month or $144/year): everything in Plus, plus 4K at 60fps, longer duration, multi-transport legs, text waypoints, and photo waypoints.

6.1 Payments

Paid subscriptions are billed through Stripe. By starting a paid plan you authorize recurring charges according to the interval you select until you cancel. Taxes may apply.

You can cancel or manage your subscription through the Stripe customer portal linked from account billing settings. Cancellation stops future renewals; it does not generally refund the current paid period unless required by law or expressly offered by us.

Still-image (PNG) exports follow the same resolution and watermark rules as video for your plan and do not consume Free video export quota.

7. EU consumer withdrawal (14 days)

If you are a consumer in the EU/EEA, you generally have a 14-day right of withdrawal from distance contracts under Directive 2011/83/EU.

For digital content or services supplied immediately, that right may be lost once performance begins with your prior express consent and acknowledgment that you lose the right of withdrawal. When you start a paid plan and immediately access Plus or Pro features (or request an export under that plan), you ask us to begin performance. If you withdraw within 14 days where the right still applies, contact support@vianim.com.

Nothing in these Terms excludes mandatory consumer rights that cannot be waived under the law of your country of residence.

8. Intellectual property

Vianim and its licensors own the Service software, branding, UI, and documentation. These Terms do not transfer ownership of our IP to you.

Map tiles and terrain imagery are provided by Mapbox and may include OpenStreetMap data. Map data and terrain imagery © Mapbox © OpenStreetMap contributors. Your use of maps must comply with applicable Mapbox and OpenStreetMap attribution and terms.

9. Availability and changes

We aim for reliable availability but do not guarantee uninterrupted Service. Maintenance, third-party outages (maps, payments, cloud), or force majeure may cause downtime.

We may modify features, plan limits, or these Terms. Material changes will be reflected by updating the “Last updated” date and, where appropriate, notifying you by email or in-product notice. Continued use after changes take effect constitutes acceptance to the extent permitted by law. If you disagree, stop using the Service and cancel any subscription.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not warrant that exports will meet every creative or commercial requirement, or that map imagery will be free of third-party tiling errors.

Route geometry and elevation depend on your GPX source and map/terrain providers; we do not warrant absolute geographic accuracy.

11. Liability

Nothing in these Terms limits or excludes liability that cannot be limited under applicable EU or member state law, including liability for death or personal injury caused by negligence, fraud, or willful misconduct, or mandatory consumer protections.

Subject to the previous paragraph, our total aggregate liability arising out of or relating to the Service in any twelve-month period is limited to the fees you paid us for the Service in that period (or €50 if you are on the Free plan and paid nothing).

We are not liable for indirect, incidental, special, or consequential damages (including lost profits, lost data, or lost exports after the 48-hour purge window) except where such limitation is prohibited.

12. Governing law and disputes

These Terms are governed by the laws of the EU member state in which Vianim is established, without regard to conflict-of-law rules that would require another jurisdiction’s law, and without prejudice to mandatory consumer protections of the country where you habitually reside.

EU consumers may bring proceedings in the courts of their place of residence. You may also use the European Commission’s Online Dispute Resolution platform where available.
